FIESTA RESORT
These rules and regulations (hereinafter referred to as the “Regulations”) govern the terms and conditions of the promotion carried out by FIESTA RESORT (hereinafter referred to as the “Hotel”), consisting of quarterly and annual prize draws among guests who complete the satisfaction survey sent at the time of their check-out.
I. DEFINITIONS
HOTEL: Hotel Fiesta Resort, located in El Roble, Puntarenas, Puntarenas, managed by the company HOTELES DT PUNTARENAS, SOCIEDAD DE RESPONSABILIDAD LIMITADA, corporate ID number 3-102-692078, which is the organizer of this promotion.
PARTICIPANT: Any natural person over eighteen (18) years of age who has stayed at the Hotel, fully completes the satisfaction survey sent to the email address registered at check-out, and accepts the terms and conditions set forth in these Regulations.
SURVEY: The satisfaction questionnaire automatically sent by the Hotel upon completion of the check-out process.
PRIZE(S):
Quarterly Draw: One (1) day pass for two (2) people.
Annual Draw: One (1) all-inclusive stay for two (2) adults and two (2) children.
TERM: The promotion is indefinite and will remain in effect as long as the Hotel decides to continue it.
II. PARTICIPATION REQUIREMENTS
- Have been a registered guest at the Hotel.
- Fully complete the Survey.
- Accept these terms and conditions.
The following individuals are not eligible to participate:
- Hotel employees and their relatives up to the second degree of consanguinity or affinity.
- Suppliers, distributors, and third parties providing direct services to the Hotel.
Only natural persons with a valid and current identification document issued by a competent authority may participate.
III. DRAW MECHANICS
- Draws will be conducted electronically through random selection among Participants who completed the Survey during the corresponding period.
- The Hotel will prepare a record or minutes of each draw, indicating the date, selection method, winner, and alternates.
- Winners will be notified via the registered email address.
- Each winner will have thirty (30) business days to respond and coordinate the details regarding their Prize.
Failure to respond within the indicated period will be considered a waiver of the Prize, which will then be assigned to an alternate or declared void.
IV. PRIZE DELIVERY AND CONDITIONS
Prizes are personal and non-transferable, non-negotiable, and cannot be exchanged for cash or other goods or services.
Prize enjoyment is subject to Hotel availability and is not valid during peak seasons, holidays, or restricted dates as defined by the Hotel.
The winner must appear in person with a valid identification document to claim the Prize. Proxies or authorizations will not be accepted.
The Hotel reserves the right to modify the Prize conditions in cases of force majeure or unforeseen circumstances, without incurring any liability.
V. IMAGE RIGHTS
The winner irrevocably authorizes the Hotel to use their name, image, and voice, without any compensation, for promotional purposes related to this activity. Likewise, the winner authorizes the taking of photographs or videos during the delivery or enjoyment of the Prize, releasing the Hotel from any claims related to image rights.
VI. LIABILITY AND DISCLAIMERS
Participation in the promotion implies full and unconditional acceptance of these Regulations.
The Hotel shall not be liable for:
- Emails not received or rejected due to technical failures beyond the Hotel’s control.
- Incorrect or false data provided by Participants.
- Additional expenses incurred by the winner to enjoy the Prize (e.g., transportation, personal expenses, taxes, administrative procedures, etc.).
- Accidents, damages, illnesses, deaths, or any kind of harm suffered by winners, their companions, or third parties during the use or enjoyment of the Prize.
The Hotel’s liability is strictly limited to the delivery of the Prizes under the terms established herein.
VII. MODIFICATIONS AND SUSPENSION
The Hotel may modify, suspend, or cancel this promotion at any time, without prior notice and without incurring any liability to Participants.
VIII. APPLICABLE LAW AND JURISDICTION
These Regulations shall be governed by the laws of the Republic of Costa Rica. Any dispute arising from this promotion shall be submitted to the competent courts of Puntarenas.
